Artykuł porusza kwestię wyłączenia dobra potomstwa na przykładzie spraw rozpatrywanych przez Sąd Diecezjalny pierwszej instancji w Rzeszowie. Analiza poszczególnych akt prowadzi do wniosku, że pomimo różnych form wyłączenia dobra potomstwa, podstawowym powodem tego wyłączenia jest lęk przed posiadaniem dziecka. W opinii osób wyłączających dobro potomstwa, dziecko stanowi zagrożenie dla ich wygodnego stylu życia oraz realizacji indywidualnych planów i aspiracji.

Exclusion of the „bonum prolis” illustrated with the example of the judicature of the Episcopal Court in Rzeszow

The article deals with the issue of excluding the good of the offspring as exemplified by the cases examined by the Diocesan Tribunal of the first instance in Rzeszów. The analysis of individual records puts forward the conclusion that, despite various forms of excluding the good of the offspring, the basic reason for this exclusion is the fear of having a child. In the opinion of those who exclude the good of the offspring, a child poses a threat to their comfortable lifestyle as well as their pursuit of individual plans and aspirations.

L’article traite de la question de l’exclusion du bien de la progéniture, illustrée par les cas examinés par le Tribunal diocésain de première instance à Rzeszów. L’analyse des dossiers individuels conduit à la conclusion que, malgré les diverses formes d’exclusion du bien de la progéniture, la raison fondamentale de cette exclusion est la peur d’avoir un enfant. Selon ceux qui excluent le bien de la progéniture, un enfant constitue une menace pour leur mode de vie confortable ainsi que pour la poursuite de leurs plans et aspirations personnels.
